The Personal Data Protection Office imposed an administrative fine on Pactum Poland Sp. z o. o. The reason for the fine was the company’s lack of cooperation with the supervisory body, which consisted of a failure to provide access to personal data and other information necessary for the performance of the body’s tasks.
In order to ascertain the facts of the case initiated by the complaint, the Personal Data Protection Office requested the company to respond to the content of the complaint and answer specific questions about the case. Four requests were sent, the company received only one, to which it did not reply.
According to the Office, the failure to reply to the questions and answer the summonses shows a lack of willingness to cooperate in determining the facts of the case. Moreover, it is a breach of the obligation to provide the supervisory authority with access to information.
In the opinion of the Office for Competition and Consumer Protection, an entity professionally involved in legal and economic activity, such as Pactum Poland, is aware that its action of not responding to correspondence sent by the supervisory body constitutes a breach of the basic obligations of an entrepreneur.
The fine imposed on the company in the amount of over 18 thousand PLN has already been paid.
