People with CHF mortgages are suing Millennium Bank over high insurance premiums of low contribution insurance

The Wyborcza.biz portal reported that almost a hundred holders of mortgage loans in CHF have sued Millennium Bank for the high cost of insurance premiums of low contribution insurance. Class actions in the above-mentioned subject have been brought recently to the courts, among others, in Krakow, Warsaw, Katowice and Poznan. 

The case mainly concerns mortgage loans which were taken out in CHF during the period of the greatest real estate boom in 2007 and 2008.

The bank required borrowers, who did not contribute a minimum of 20 percent of the cost of a property’s value, to purchase an additional low contribution insurance. The value of this insurance policy amounted to 3 percent of the amount of the borrower’s contribution which was lacking.

The premium was payable every three years. In 2016 of the next payment of the insurance low contribution premium is due. For this reason, more and more people are filing a statement of claim in court, hoping that the court will abolish the obligation of purchasing this additional insurance policy and will order a refund to clients of earlier payments made. 

Clients also complain that at the time of taking their mortgages they were informed only about the obligation to purchase additional „insurance cover”. These clients argue that nobody explained to them the condition of the insurance and that they did not receive the appropriate documents, including the insurance contract.

In 2015 in a similar case, the court described the activities of another institution as „wicked.” The plaintiff sued a bank over high insurance premiums and the inability to access the contract. During the court proceedings, facts were presented, according to which, premiums were in fact much lower than the amount paid by the customers. The clients’ representatives  are convinced that further lawsuits will be brought.
