Regulation on data provided to UFG

On 2 August 2016 the Regulation of the Minister of Finance of 8 July 2016 on data gathered for the IT database of the Insurance Guarantee Fund (Journal of Laws of 18 July 2016, item 1040) entered into force.

The Regulation stipulates the detailed scope of data gathered in an IT database, referred to in the relevant provisions of the Act of 22 May 2003 on compulsory insurance, the Insurance Guarantee Fund and the Polish Motor Insurers’ Bureau, and the time limit for providing the data to the Fund. The data concerned includes data of:

  • insured, co-insured, policyholder, injured, beneficiary or a person entitled to receive benefit or compensation;
  • holder or drivers of motor vehicles involved in an accident, service providers participating in the claims handling process,
  • owner and co-owner of the insurance subject, lessors,
  • witnesses of an accident, experts and physicians participating in the claims handling process,
  • legal guardians of the insured or a third person, on behalf of whom the insurance contract has been concluded, care providers, persons living in cohabitation.

The data gathered in UFG’s IT database includes i.a.:

  • information on concluded insurance contracts (conclusion and termination date),
  • information on the vehicle (i.a. VIN, car body, chassis or serial number, registration number, make, model),
  • scope of an insurance company’s liablity with respect to  an insurance accident under which the claim has been raised,
  • raised claim (i.a. data on accident – country, city, description of the place, and the type of accident, date),
  • information on claims raised and on paid and refused compensation and benefits, and on reasons of refusal.  

In accordance with the Regulation, an insurance company is obliged to provide UFG with the data immediately and no later than within 30 days of the receipt of the data concerned.
