Tomasz Chróstny initiates proceedings in the Apple case

Tomasz Chróstny, President of the Office of Competition and Consumer Protection, initiated investigation proceedings in connection with changes in privacy policy and processing of personal data introduced by Apple.

Information made available by users of mobile devices during their online activities is used to present personalized ads. The information is collected by application developers and operating system developers. In connection with the change of privacy policy and processing of personal data on Apple devices, Tomasz Chróstny initiated an investigation. This applies to all products with operating systems: iOS 14.5, iPadOS 14.5, tvOS 14.5 and their later versions.

The change, which is being analyzed by the president of the Office of Competition and Consumer Protection, has led to the extension of obligations regarding the need for apps to obtain permission to track user activity. This means that on iOS operating systems, the possibility of acquiring personal data in order to send personalized ads by third party applications has been limited. However, information about users has not stopped being collected and they still receive personalized ads. This has raised questions as to whether the rules established by Apple were not intended to promote its Apple Search Ads service, which could violate competition rules.

The investigation is being conducted in the case and not against specific businesses.
